Do all adoptions require a home study?

For example- Non custodial parent- severed parental rights. So the child is all mine. My husband wants to adpot her and has raised her as his for the past 3 years. Me, being her mom, can I have my husband adopt her or does there still have to be a home study written?

All info would be great!! We live in CA

  1. No.  What happens is that someone investigates the stepparent and the court may choose to order a homestudy after receiving that investigation report. In some jurisdictions, the judge always orders a home study, but I don't think that's the norm.

  3. I really don' t think you need a home study for that.  It sounds like you are the biological mom, so it shouldn't be much of a problem.  I would double check with an attorney to be safe.  I did an adoption through California and there are great adoption lawyers out in that area.  Good Luck!

  4. In CA you will definitely have a home study performed. Everything is done to ensure the safety of the child involved.

  5. I don't know about if you will need a home study for this type of adoption- however we are from calif. and we had a homestudy for both of our adopted kids- 16 and 19 years ago- and I can tell you from personal experience there is really nothing to it. It was very easy.

  6. not sure about in CA but some states do. And it would be a state rule and not up to the judge. But a homestudy in a step parent adoption would not be as much as a regular adoption.
