Do army men have the same rules as we do?

ok my ex husband is in the army and has been for 6 mon.and hasn't payed any kind of support for his child. now he is on leave and is taking me to court to have his visitation given to his mom but i sin a paper stating that i would take care of her tell he was out of the army what law do we have to go by county or the uniform ot justis codes

  1. Teegan clearly is a misguided possible previously hurt female by a military man and is taking out her aggression upon others... just be quiet.

    to the OP if you get it in writing that he has to pay child support and take it to his chain of command the army WILL make him pay it and will just take it out of his pay before he sees it


  2. The Uniformed Code of Military Justice (the Law the military lives by) covers only criminal law.

    Divorce and child support issues are civil cases, thus they are handled by state and county courts.

    Since these types of judgments vary from state-to-state, the military would be bogged down trying to train JAG officers in various local laws when they PCS every couple years.

    Contact your local DSHS and ask how to have a CASA or Gaurdian ad Lidem assigned to your child. You'll get more done faster that way.

    Tegan: I am NOT a mysoginistic military man. I am a family therapist. However, I do know the UCMJ is 100% Consitutional, and does NOT go against human rights.

    Additionally, in my experience, most military men, like most civilian men, are very good family men.

  3. i know several people who are or have been in the military and their child support was taken directly out of their checks. so once you find out who to talk to and get the ball rolling he won't have a chance to not pay. as for the visitation issue with his mom can't help you on that part other than i do of one Grandma who tried to get visitation rights to her 2 Grand kids, and the judge told her she has no Grandparent rights. It was up to the ,other in this case to keep her informed,and allow her to see them if she so chose to do so. That was in Oregon about 8 years ago, and it was my Aunt she told me this herself so it is not here say or a friend of a friend told me.

  4. NO! And this is exactly the problem I have with it.

    The military has it's own laws, most of which go against the US constitution and basic human rights laws. Anything which is technically not allowed, like rape, is quickly covered up by the misogynistic officers.

    Learn from this: if you want to be treated well, dont marry someone in the military.

    Ok then, explain Guantanamo Bay?! Just because they don't do it on American soil doesn't mean it's acceptable.

    And rape IS covered up. I have female friends in the military who were encouraged by officers NOT TO REPORT IT. If you really are in the military, then you'll know that rape is rife.

    This is a typical argument used to deride and silence women. Rape victims are lying. Sure they are.

    LOL! I can do without the help of a rapist, thank you very much. You'd obviously like all women to sit down at your feet and nod their heads to everything you say.

  5. The Uniform Code of Military Justice doesn't cover civil law or anything concerning child support. That matter is handled by the state courts. If the judge says he has to pay child support then he has to pay it. Soldiers have to abide by civilian laws as well as military laws.

    EDIT: Tegan the dream, like I told you before...just because you surf the military section on Yahoo Answers doesn't make you a subject matter expert. You are not only wrong in your answer but cleary show a lack of intelligence and knowledge on the subject. The UCMJ does not go against the Constitution or any Human Rights laws. Rape is not covered up...I'm an MP and have worked my fair share of rape cases. You have no idea what your talking about. All you're doing is proving your ignorance.

    EDIT: Tegan, The detainees in Cuba are SUSPECTED TERRORISTS, not soldiers. The UCMJ does not apply to them because they are not U.S. servicemembers and is not being used as a basis to detain and prosecute them. Federal law is being used for that. Do some research and will sound like less of a r****d.

    Second, your friend is probably lying...in fact, I'm willing to bet a month's a pay she is lying...if she is even real. Who knows you might just be saying that considering your saying allot of other untrue things. I do know that no commanding officer in their right mind would cover up the rape of one of their soldiers.

    And I am really in the military, I've been in 8 years and am a non-commissioned officer in the U.S. Army. I have no reason to lie, and I tell it how I see it.

    EDIT: Tegan, I didn't say rape victims lie...I said your friend was lying...and then I doubted her existence because you seem to say allot of untrue things. Basically, I'm saying YOU are lying. I'm not trying silence women, I'm trying to tell you that you are ignorant and have no idea what your talking about. You are making assumptions without looking at the facts. You are not intelligent on the subject and your statements are untrue. You are truly lost and misguided, and until you can see that, we cannot help you.

    Also, My apologies to the person who asked the question. I didn't mean to turn your question into an argument. Just please do not listen to the ignorant people that have no idea what they are talking about and cannot support or prove their answers.

  6. All matters dealing with visitation and child support will be handled by civilian courts. The soldiers still have to abide by the federal laws as well as the UCMJ.

    And Tegan, as far as you saying "If you want to be treated well, don't marry a soldier", I'll have you know that I am married to one, and he treats me like a princess, and goes above and beyond to make sure I am happy. You may have had a negative experience with one, but one bad apple don't spoil the whole bunch!
