  1. Most insurance companies will not pay a claim where there has been a DUI


  2. No. They don't give you more $ just because the driver was DUI. Not sure which side of this you are on. Usually there are no provisions that say that those claims are handled differently than any other. I think that in some state you can get punitive damages for DUI, but I don't know for sure.
