Do check pay to have to match the company name EXACTLY according to law?

I deposited a few checks worth about $ 80K into an exisiting corporate checking account that I have had for years, from a MAJOR US corporation. Due to corporate burocracy, havng the checks replaced would be unreasonable, so when they arrived (2 months late!) with a slightly different iteration of our company name, (ie: We are "Jones, Smith & Doe Corp", they made them out to Jones, Smith, Doe, Inc & Assoc."), I deposited them anyway. We own the Federal Trademark to our name and there is NO ONE with a name ANYWHERE near ours, ANYWHERE, so there is ZERO chance these belong to another company, they are ours. Of course, the bank didn't agree and immediately reversed the deposits, causing over $ 1000 in bank fees, NSF fees, and bounced payroll, TAX & vendor checks, knowing FULL WELL, these are legit & belong to us. Now they say they are "mailing them back" to us within 7-10 business days. In the meantime, we are hostage, & the vendor won't replace them withoutus returning these.

  1. Yes, the name has to match exactly.  Your name may be one thing but the checks were made out in a different name.  Your corporation papers are on file for one name, not the check you presented for deposit.  There IS a difference between incorporation and a corporation.

    Oh and blame it on the company who wrote the checks for s******g up.  The bank is just following their policy.


  2. I don't think there is a problem. My former company received many variations of their name and almost always was able to accept the check. I think as long as a reasonable person could make the correlation you are ok.
