  2. The answer to this question varies by state. In NM anything above 15 passenger capacity falls under CDL classification. Check with your state MVD to be sure, but you should be safe if your dont exceed 15 people.

  4. Federal regulations:  

    You need a CDL if carrying 16 people or more (including the driver).  - Class C CDL, P endorsement.

    If the passenger vehicle GVWR - not scale weight- is over 26,000 pounds (26,001 or greater) then you need a class B CDL with a P endorsement.

    If that same vehicle is air brake equipped, you will need an airbrake endorsement as well, but only if operating one of the above vehicles.

    If the passenger vehicle falls under 15 passengers, you DO NOT need a CDL wether it is equipped with air brakes or not.
