  2. No.  Given the number of lawsuits that such a practice would cause, to do so would be unwise.  Employers and employment agencies have to be very careful with negative history on former employees.

    People become very litigious when they have been "blackballed."

    The best way an employer or agency can avoid employment related litigation is to have the people they terminated get hired by someone else.    It is a rare employer that will circulate any negative information about a former employee.
