Do grandparents have rights to claim grandkids?

Ok so my 17 year old brother and his girlfriend are having a child, but they don't want it. Is there any legal way for my mother to claim the rights of the baby if my lil brother won't sign them over.

  1. i'm not sure about grandparent rights, but you could have an adoption type thing with the mom and a kid


  2. Yes, you have to hire a lawyer and go through so much legal BS but it can happen, you have to be able to prove they are unfit parents and they can not support or care for the child in a safe way. Your mother could be granted legal guardianship and after many years attempt to adopt.

    Its a long shot but it does happen and grandparents have rights as long as they are in the life of the child and support the child more than the parents do.

    If he wants to adopt the child to a different family, he can do that then and your mom would have no rights but considering he is 17 and if she is underage when the child is born they have no choice to give the child to your mother or the childs mother the choice is within the parents rights at that age.

    I can understand why he would want to adopt out of the family though, if they both want nothing to do with the child and want the child to live a normal life with a family where he or she will not be around, they want to do it for a reason. How odd would that be when the child grows up and finds out his dad has been around all along.

    Either way I hope what happens is in the best interest of the child

    My brother in law and his wife have custody of 3 of their grand kids, the daughter was just not ready for such responsibility, she didn't give them legal custody at first but they were their guardians at first she was not yet of age then she was 16 or 17 your mom has the right until your sister is of legal age, she could go to court if she thinks your sister and/or bf are not capable of taking care of it.  Have you mom talk to them and all other resources to get info on that.  Good Luck!! i sure wish i could do more.

  5. Grandparents do have rights. Because our system, is set up that , children are to be raised with relatives, if not the parents then the grand parents.

    My grandparents were able to obtain legal gardenship of me then when I was 5 legally adopt me. Because of this, I will always be grateful ...I had a wonderful childhood!!
