Do i have a court case?

i bought a truck a few months back, the guy who sold it to me said it would pass smog no problem. so i bought it...(stupid) i took it to get smoged and it %100 failed smog test and will cost over $2000 to get this fixed, i asked the guy back for the money he said no, but he could get the registration taken care of because he had a "hookup" at the dmv who would just sign it illegally. I am wondering if i am able to sue for reimbursement or something in small claims? The bill of sale does not say as is.

  1. The Lemon Law is only for cars purchased from a dealership, not individual people. If i was you i would tell him to have his friend sign the registration, then take that registration to him and say, now give me my money or i take this to the police and show them that my car was "Passed" illegally, your friend will be in trouble. your decision. I love blackmail.

    you could always sell it also, put it on E-bay, many states do not have smog tests, sucj as Iowa where i am from.


  2. you bought as is with no written agreement that it would pass. so most likely not. i would contact a lawyer though

  3. Look up your states "Lemon Law".  You might have recourse under that.

  4. Dress up very professionally, and go to the local police dept.  Ask to speak with a detective.  Tell him/her your story and ask if s/he is interested in an undercover "illegal signatures" sting at the DMV.  If the undercover sting goes well, sell your story to a magazine for $2000.  Use that money to pay to fix your truck.  

    If the detective says no, go to your newspaper and ask them to do the same, hopefully with the same monetary results.

    If the newspaper declines as well, there are several lawyers that will give you an hour of their time for free.  Ask them if you have a case.
