Do i have rights to a council place?

i have a flat with my girlfriend she has met someone else and we have split up . . the flat we have is a council place . do i have rights to my own council place if my name is on the tenecy? someone said something abput a relationship breakdown policy do i have rights. though that please help. i cant stay for long its driving me mad . i just want to get a flat near so i can see the kids

  1. If you leave you will be classed as making yourself intentionally homeless as it's a joint tenancy you would have to go to court to fight over the flat you two have at the minute (even if you say she can have it you must not take your name off the tenancy)

    It's really unlikely the council will give you anywhere until after you have been to court

    even then you would be lucky to get a 1 bed flat

    they would probably put you in a B&B until something suitable came up


  2. First make sure you fill in all the forms plus exsplain your situation. Let them know it was no fault of your own and ask your ex girlfriend to give you a letter to say that she has thrown you out. exsplain about the children you would like to have to stay now and then and state their ages and what s*x they are boy or girl .Then it will depend on points and the area you are in. Do not moan about what they give you just appreciate it as in time you may be able to find a property that you would like.

    dont leave or you will be making yourself homeless

    go to the housing department for advice

  5. Its easier to rent privately... If you mean you are moving from the flat you have to try and get another one, I doubt very much you will get one as they're are other priorities rather than homing a normal single man.

    Try ringing you local council and asking them about your situation... If your name is on the tenacy, tell her to leave...

  6. Go and speak to the council they all have different policies, don't walk out until you know the answers from them. Although in my experience they will probably tell you as you are classed as a single person (now) there are others higher up on the list of priority, and therefore you would be better off renting privately. The housing lists all over the country are very long and few single people, fit and healthy, and earning will get priority anywhere!!  Sorry.

  7. I am a little unclear , how is it your girlfriend and then you

    say you want to be near the kids ? are they both your kids ?

    You need to be more specific,  if for instance they are your

    children , you can claim that they stay part time with you.

    Also by law you can ask to see the children so many days

    a week at your place.   Whilst this is happening, the flat

    should still be okay for you to stay in.

    just check with the housing authority.

  8. I got extra points for a relationship breakdown, but it was my ex's name on the lease.  I was rehoused within a month with my local housing association.  

    I dont have any kids so you will probably be rehoused quicker even though the kids arent staying full time with you, as they will have nights to stay over with you etc.
