Question:

Do i have to payback statutory maternity pay?

i'm due back at work but 2 weeks ago we had to move in with my mum and i'm too far away to go back to the same place i was at. if i do have to pay it back can i do so by working elsewhere as i know the money gets refunded from the government to the company i'm currently getting my pay from.

i tried to ring ACAS but the call got ended as i was waiting.

  1. No you do not need to pay SMP back, even if you do not plan to return to work.

    However if your company pays you more than SMP under contract, then you may have to pay the extra back.


  2. no not at all that is yours.. I am on smp at the moment and next month I am handing in my notice I asked ACAS and that's what they told me you still have to give written notice but thats it .. good luck

  5. NO, you do not have to go back to work and can still claim the smp if you do not intend to go back to work

  6. i work for the government and there is no way they will reimburse any money you owe to the company, and it depends entirely where u work, if you work for hmrc, bt, nhs, all the big uk companies you will have to pay a percentage back of the amount, as they normally give you full pay for longer and half pay for longer. with myself i had to go back to work for 3 months for 16hrs a week, as did my sidter in law who is in the nhs, before leaving...

    ... however if you work for a large company u may be able to be transferred to do the 3 months

    e.g my sister in law was a health practioner before pregnancy for nhs, she moved to a little doctors surgery being a receptionist still for nhs for her 3 months before leaving

  7. you don't have to pay it back, the having to work 3 months in larger companies is for contractual maternity pay which is paid (only to some people by some companies) on top of your statutory pay. I will be getting CMP on top of SMP and am required to return to work for at least 3 months or will have to pay it back. My statutory sick pay is unaffected if I quit.

  8. No you don't have to pay this back luv - that's why we work to get a little back from the government when we need it - you still have to give a written notice from the end of your maternity leave but that is it x*x
