My ex husband- the biological father of my son, recently relinquished all rights...this is so that he did not have to pay the $40,000 in child support. Since this time my husband, who has raised my son since he was 4 years old stepped up and adopted him. I am now getting paperwork requesting that I send coopies of documentation to my ex-husbands attorney. Do I need to do this?

  1. Laws differ from state to state.  It is best that you contact your attorney regarding this.  Your ex-husband did relinquish his parental rights, so he is no longer legally your and his son's father, so there might not be a legal need for him to receive these documents.  However, since he is still his father by blood, it's good for your son that his first father know that he has been adopted.  You really need to find out from an attorney what your legal responsibilities are, though.

  2. he still needs to sign off.

  3. Yes.  It would really be best, otherwise he can say you haven't been completely honest with everything.  Have your lawyer send them to his lawyer.

  4. Depending upon the state you live in, yes. Here in Oregon I had to.

  5. Yes, to prove that your son is now in the care of you and his new father.
