Do i have to show up in court for this ?

my husband and i have a home in another state and over the past weekend we had to go and clean our house out to rent it again due to an eviction. while there, the former tenant came to a neighbors and started a fight with my husband and i cussing and threats came from her until it progressed to her shoving my husband, spitting on him and trying to hit him. all this happened after i threatened to call cops if she didn't leave. we called the cops out because of her actions and my husband decided to file charges against her and my neighbor and i had to fill out a witness form. the police said later that we'd have to show up in court possibly next month for the charges. is this true that we definitely have to show up and if so when do they subpoena us or summons us to court after it was filed. this all happened around 1 p.m. on saturday and we havent rreceivedanything yet.

  1. If you are required to appear in court, your husband will have to file the subpoena ad testificum. To have a witness testify for him. But it really depends upon your state laws.


  2. Of course you have to show up to court to have charges filed against them.

    They have to subpoena you or summon you to court. Usually you get the subpoena in the mail since this is a court case. Unless you are subpoenad by a private individual, then the subpoena would come to you by a process server.

Yes you will be notified  and you do have to show up in court if you want any chance of winning.Or what was the point in filing charges? no they don't believe they subpoena you for this kind of complaint that is more for something serious such as a felony or murder.you can call the police and ask they should be able to tell you more information for your area.

  4. If you don't show up the judge will probably drop the charges.  

  5. If you don't show, the charges will likely be dismissed, since you aren't there to press them; and you may be saddled with court costs since you didn't bother to show after you started the ball rolling.
