My husband is in the Navy and were stationed overseas. I got my CR1 last April and now that I'm going to States to visit my in-laws and stay there for 2 weeks and come back here in Japan to finish the 3 years order of my husband.

Now my question is do I still need to get a re-entry permit? Am I going to have my green card even though i just stay for 2 weeks? Cuz were planning to go back in states again this coming November to spend Thanksgiving,

Thanks!

  1. You will not need a Re-entry Permit. Here's the reason why:

8 CFR 211.1(a)(6)  A Form I-551, whether or not expired, presented by a civilian or military employee of the United States Government who was outside the United States pursuant to official orders, or by the spouse or child of such employee who resided abroad while the employee or service person was on overseas duty and who is preceding, accompanying or following to join within 4 months the employee, returning to the United States.

No matter how long you're gone, if it is because your spouse is on government travel orders, you may remain abroad, and you will not need a Re-entry Permit to return. Form I-551 means green card.
