  1. No............ you need a police report and then just turn everything over to your insurance company and they will do all of the leg work for you, you dont need a lawyer, he was backing up it is his fault.....

  2. moving or not moving doesn't matter the person backing up is always wrong. Easy piece of cake case. If you were injured make sure to seek medical help. If  you lose time from work you need to be compensated for that as well. Easy case you don't need a lawyer. They will want to settle quick as the insurer for the other party knows it is responsible. Don't worry about it. If they offer a ridculously low amount which they always will alway counter it and sometimes counter it again until you get what you deserve what is fair. Tell them that they will have to pay even more if you decide to get a lawyer. You are actually trying to save them some money by not going the lawyer route.

  3. This could be complicated. There are too many variables to say who was at fault in your case. You haven't presented enough details. Hire the lawyer if you think you weren't at fault.

It is NOT true that the guy backing up is always at fault. For instance, if you had a stop sign and he didn't, you are at fault.

  4. Only if the other person at fault is unwilling to pay or is denying the accident ever happened.  If the cops were not involved you have no proof.  Pictures are nice..  A lawer can't do much more than you.

  5. the person in reverse has to give way. dont worry about it.

  6. If you were still moving at the time of the impact then it could get messy. If you were at a stop then you don't need a lawyer because the other guy was clearly at fault.
