Do i really need a lawyer?

i am currently bringing my fiancee over from germany on a fiancee visa. the paperwork does not seem that hard. do i really need a lawyer to file? is the process quicker with the lawyer?

  1. Do you mean the Prospective Marriage Visa (Subclass 300) or a Spouse Visa (Subclass 309/100)?

    If your partner is gonna apply in Germany, try to get the accelerated process (whatever its called). Thats when he get an appointment in Berlin, present your case and they decide there and then. Saves you weeks of waiting.

    I am German and on a Spouse Visa.


  2. no need for a lawyer unless you have an unusual case (arrests, criminal records, overstaying visas, etc). having a lawyer or not neither increases nor decreases the wait for the visa.

  5. A lawyer will be an asset to you if you can afford it. When doing something like this, you don't want to take any chances. I would sit down with one to look over the papers and make sure everything is filed properly. Wouldn't want your husband deported due to a paperwork error. Lol.  

  6. Call or go to Legalzoom.com I see good commercials about them. their not lawyers they just help you with legal papers

  7. Hiring lawyer doesn't excatly speed up process of getting visa. It could speed up preparing to file the petition.  

  8. Personally, I wouldn't use a lawyer (unless there are certain problems in applying for your fiance visa). Just read and follow the instructions carefully and do lots of research (http://visajourney.com is a lifesavers!) then you'll do fine.

  9. You don't need a lawyer unless there are factors that complicate the case like a criminal history or one or both of you having filed previous K-1 applications and even then you still might be able to go it alone.

    Using a lawyer actually slows the process as you still have to gather all the papers yourself then give them to the lawyer who will file on your behalf.  I found it easy to do by myself. Once you have all the paperwork you need as evidence you can fill out the forms by yourself in less that 3 hours. That's allowing for checking as you go to make sure you get it right.

I was once a K-1 visa holder and we didn't hire any lawyer to file our petition.It is not that hard (except for the waiting of approval) esp if both of you don't have complicated issues that may affect the petition.All you need to do is read all the instructions and requirements and double check them again before sending in to make sure you have submitted all the required documents. You can start reading up on the requirements in www.uscis.gov and another useful website is www.visajourney.com where you could meet other people in their forums who has the same situation as you.They have a useful guides/flowcharts and members shares useful informations.Good luck.
