i just received a letter in the mail that i owe the irs 1200 from a 06 refund. ( after 2 yrs..how funny) can i still recieved the stimulus check

  1. No.  According to the IRS:

    Q. I'm eligible for a payment but I still owe federal income tax from a prior year. Will my payment be reduced?

    A. Yes. For this purpose, the stimulus payment is treated like any other tax refund. This means that part or all of your payment can be used to pay past-due federal or state income taxes or non-tax federal debt such as student loans and child support. If this occurs, you will receive a letter explaining how the stimulus payment was applied.


  2. NOPE.  Your stimulus rebate will be applied to your tax deficiency, decreasing what you owe.  The IRS frequently takes 1-3 years to examine tax returns carefully and assess deficiency.

  4. they will probably take it. I owed money on a student loan and they took my hubbys check!!

  5. Why is it funny?  With the millions of returns that the IRS processes, it takes about that long for them to complete all of the checking of returns.

    Did the letter just say that you may owe that money and give you the opportunity to dispute it, or was this closing out a case where you have been found to owe it?  If you definitely owe it, your stimulus check will be applied to it.  If it was just an initial letter and hasn't been finalized yet, you might get your check or it might be withheld.

  6. No, you won't receive a stimulus check unless your stimulus rebate is more than what you owe the IRS.  In that case, you'd get whatever was left over after the debt was paid.

    FYI, it's not at all uncommon for the IRS to take a year or two to complete a review of your tax return.  They do have 3 years from the filing deadline unless tax evasion or tax fraud are involved or if you significantly mis-state income or expensed and deductions.  There's no time limit on fraud and significant mis-statement of income or expenses gives them 6 years to complete their review and assess any additional tax.

  7. They will take the stimulus check.

    Don't be surprised that it took the IRS 2 years to tell you that you owe them money.  They must have found out something that you didn't report on your 2006 taxes.  You will need to get this resolved ASAP.
