Do i still owe money on a second mortage?

Is a debt still owed if the creditor has stated that it has been paid in full in probate court but yet they still sending a bill and saying the debt is still owed?Also i do not own the house and it has been released once already and was tried to be reinstated but was released again

  1. Yes.

    If the mortgage was taken out by you and the deceased the creditor is merely accepting the fact that they aren't seeking repayment from the deceased (or his/her estate) but they aren't letting you off the hook!  The fact that you don't own the house has nothing to do with the fact that you still owe on the second mortgage unless you can show proof the 2nd mortgage lien was satisfied upon the sale of the house.

  2. A loan has been paid off when the last payment has been paid. Nothing in Probate Court papers causes a loan to disappear.  So you need a checkbook showing that all payments were made.  If you don't have that; why not?  The bank has the records and you can get them.

    You mention that you do not own the house but you don't tell who does.
