Do job applicants have any rights if a company offers a job and then with draws it later?

My son was offered a job with Blue Cross/Blue Shield which he accepted.

After turning down other bona fide employment and being put on hold for about 2 weeks they resended after he mistakenly took some of my daughters Darvacet pills for pain...,he had a prescription for Lora tabs and muscle relaxers for a hyper-extended knee! We explained to HR and the screening Dr all to no avail!!

He is not a junkie or doper he just got them confused and they showed up in his urinalysis...,and of course he didn't have a prescription for them! HELP!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!... IS THIS FAIR????

  1. There is nothing you can do about it.  He should have shown more responsibility with the medications.  Now what if he would have taken something he was allergic to or administered the wrong medication to his daughters.  Fairness is not the issue.  He displayed irresponsibility and should not have gotten the job.


  2. This may not be fair but since he failed their drug tests the company has every right to do this.

    Also, there are many states that are right to work states, which means that a person can be terminated from their job at any time for any reason without notice (of course discrimination laws do apply)

    I am sorry that this has happened to your son, but maybe he will be better off in the long run and will find a better position somewhere else.

  3. Fair, maybe not.  Legal, absolutely.  Companies take drug testing very seriously.  BCBS has no proof that your son isn't a doper and there's nothing you can show them that he's not.

    Moreover, being careless about the drugs he's taking right before a drug test speaks to his judgment.

  4. Sorry.....drugs are drugs to the big Blue..........everyone has an excuse.....some good ......... some bad.........suck it up and move on.....company policy is unforgiving.........

  5. Sorry, but the offer was conditional on passing a drug screen. He did not pass.  

    It probably was an honest mistake. But look at if from the hiring manager's view point, every one who fails the drug screen has a reason or excuse. None of them are going to say..."yeah, I  am an addict, you caught me".

    I wish him luck in his continued job search.

    most muscle relaxers and Darvacet show up the same way in a drug screen they will  both show as PPX so if he had a prescription he would be fine..........

    perhaps there is more to this then your son has told you. the taking of the wrong drug may be seen as a judgment/lack of attentiveness issue and that could be more important to the employer then the screen was.
