Do local councils have to comply with car parking signs that the Highways agency have on there website??

I got a parking ticket in a local remote pay and display carpark, i hold my hands up, i did not know it was a pay and display as the signs are very small, hidden and only two in the whole of the carpark which is about 400 ft long, i have been on the Highways agency website, and the signs they show there are a lot bigger and clearer than what is displayed at the carpark in question, i would have thought that the council have to comply with the standard set by the Highways agency, is this correct, do i have a case to appeal

  1. I would've thought so too.  Try getting a picture of the small, hidden ones -and then appeal.


  2. council land is private land and outside the control of the highways department.

    You would have to fight it on other grounds.

    if there are unnusually high number of claims due to people not seeing the signs then you might be onto something. But if the ratio is average then I'm araid that shows that most people can read the signs so they are probably ok.

    I don't know of any "free" carparks these days, its always wise to be very suspicious if you think the carpark might be free adn have a look in other windscreens

  3. Was it a car park on the street or off street (you drive in off the road)?  From your description I think it was the latter.

    Highways agency will only deal with public highways, therefore on-street car parks, off-street parking would not come under their remit.

  4. it is my uderstanding that they would have to somply with these regulations are they are going to be law, just like people getting away with parking tickets for parking on double yellow lines that aren't painted correctly (yes there is a standard that must be met for these).

    You have nothing to lose, espcially if you can prove where you have seen the regulations, be carefull not to go over the reduced payment time, if you are in any doubt of wining.

  6. The Highways Agency regulations apply to the public roads in Britain.

    You got a ticket in a privately owned car-park, away from the public roads.

    Signs in a car-park do not have to comply with Highways Agency regulations, because they are not public highways.

    Simple, really...
