Question:

Do state driving curfew laws override local curfew laws?

I live in Illinois and if you search online it says that for the 16-17 year old driving phase the curfew is past 10 on weekdays and past 11 on weekends. However, my local laws in Naperville say that curfew is at these same times for anyone UNDER age 17, but does not specify whether this relates to driving or not.

So basically I am 17 and wondering if I am able to drive past curfew?

  1. DERRRRRRRRRRRRRRRR

  2. so if your in Naperville you can stay out but you cannot drive.

    Drivers Age 16-17

A nighttime driving restriction is in place Sunday-Thursday, 10 p.m-6 a.m., and Friday-Saturday, 11 p.m.-6 a.m. (local curfews may differ from the nighttime driving restriction).

  3. Contact your local department of motor vehicles and just ask them to make sure.

  4. just follow the rule!!!

  5. whichever one is earlier is the one you have to go by....so its gonna be 10  sorry hun

  6. What the state law is saying (in a clumsy way) is that you can't drive after 10 or 11 pm if you are UNDER 18...Seems like the city rule says that they don't want you on the street at all after those hours...Give the cop shop a call and see what their take is just to be sure.

    All the best.
