Do they give a J1 visa waiver easy to you, or are they really hard to get?

I plan on applying for a J1 visa waiver because I have the 2 year home requirement. I met my bf in 2005 and now we plan on marrying soon but I got a J1 visa (expired june 30 2007)with the 2 year rule so that will be gone in 2009. All I can do is apply for the waiver and I'm wondering if I have a good chance of getting it waived.

  1. It is not easy, and it is not hard, it is by a judicious application of the law.  If you qualify, you should receive it.  If not, then no.


  2. do you honestly think that your relationship with your dude has any weight with respect to your waiver that you feel its pertinent to ask alongside your question? put that in, and you're not getting it.

  3. Fred S has got the info for you here. I would add that in processing a waiver request both the Department of State and your home country's government have roles in making any decision. Plus, some J programs are very loathe to support waiver requests, making it a fairly difficult question to ask.

    Your home country government issues a No Objection Statement.

    A U.S. government agency may request an interested government agency waiver.

    Persecution.

    Exceptional hardship to a United States citizen (or legal permanent resident) spouse or child of an exchange visitor.

    Request by a designated State Department of Public Health or its equivalent.
