Do u think we can get custody?

My boyfriend just found out he is a father of a 2 year old baby boy. the mother has already had one child taken away from her by the biological father. this mother is known to be on drugs and partys often. Right now he is in shock... its only been 2 weeks since he has known! But I would like to give this little boy a good home , that is full of love... and for him to be safe. What do u think our chances are of getting full custody and what steps need to be taken?

The father needs to hire a lawyer and begin custody proceedings.  If she chooses to fight it, it could be a long drawn out process.  My brother's ex-wife was into drugs and alcohol and also had lost custody of two children.  She didn't have a permanent address, no job and a police record for things like assaulting a police officer and contributing to the delinquency of minors and intimidating witnesses.  She was caught trying to substitute her toddler's urine for her own during a court supervised visitation in which she was to be drug tested.  Nevertheless, the case dragged on for over two years.  In the end, my brother won sole custody, but only because his ex blew off another court date after being warned by the judge not to.  Most courts are reluctant to take a child away from the mother.  They will offer her every chance to straighten up her act first.  Tell your boyfriend to go through with it if he thinks it's best, but be prepared for a rough ride.

  3. First you need to contact a lawyer immediately. Second you need to file for a petition of custody thru the court, the lawyer will help you do that. You might have to file for a paternity test first if his name isnt on the birth certificate. Start documenting everything, dates, times, what was talked about, you get the picture. To show the courts that he is ready to be a father, you BOTH should take a parenting class, CPR certified and so on. It will show good faith on your guy's parts. He will need to show a steady relationship with you, that his life is steady-financially, emotionally, physically ect ect. Basically, a lot of this you dont have to do, butit is always better to cover your bases especially when dealing with a child custody battle.

  4. He firstly needs to prove that he is the father if he wants full custody.

    By the sounds of it the mother sounds like she is weird and may place the father role onto any man and it seems your boyfriend is very nice and would be a great target for her.

    You also need to get a lawyer who can fully help you with everything you need to know.

    You need to be able to prove that she is a bad mother. Like the child isn't clean or is in danger in her care.

    If you are really worried about the child right now call child protection services as a worried citizen in the community.

  6. this sounds like ugly situation -  get some advise from a lawyer soon as you both can so they can start doing there stuff you dont want this poor little bugger going threw more then he has to. did you have a paternity test done?

  8. If he can prove the mother unfit to take care of the boy then he will have a good chance of custody.  I would recommend getting a good family attorney now and start the paperwork.

  10. If what you are saying is true, then he should have no problem getting custody if he is indeed the biological father. Get a good lawyer and do it fast. Sounds like the child is in danger. Why has CPS not taken these kids away?

  11. There is a very good chance that you can get some custody right off the bat... full custody?  Probably not right away.  You would have to prove her unfit to do that.  And if you know that she is on drugs and parties often then I'm sure it will work.
