  1. Yes they have to tell drug dealers that they want to buy drugs for the members of the police department as of the Uncover Drug Informant Act of 1993

  2. Only if you ask.

  3. they do not have to tell you.  their job is undercover

  4. NO

  5. Not always.  The area surrounding entrapment is very gray.  I would suggest asking an attorney or reading the actual law about it.   also... if you are worried some one is a cop, then you are obviously doing something wrong or know someone that is... and that is against the law and you deserve to get caught anyway.

  6. If they say "do I look like a cop" or anything like that be worried. Most people who are not say no, I'm not a cop. So you just have to be careful.

  7. There needs to be a FAQ. ;-)

The answer is NO- LEOs are permitted to lie to criminals as part of an investigation. The only limit is on pretending to be a lawyer for the suspect.

  8. They will inform you if you ask.

If you suspect you're dealing with an undercover. You can ask them 1) Are you a cop? If yes, show me your badge and ID. Legally, cops undercover or not must show your their badge/ID if you've asked. If they do not and end up arresting you, you can use that in court and charges can be dropped.

  9. Last year I attended a DEA class where this came up.

    The bottom line is "no".

Even if asked, the officer can lie about it.  It's not a crime for the police to lie to you (unless they are under oath or affidavit).

  10. Your dealing with the myth of entrapment....I can tell you that I found pot in your vehicle and your friend told me it is yours and be lying through my teeth..so what makes you think I must tell you I am a cop because you ask....

You know the truth, and the light of this question, no matter the outcome and all the answers you read, you will still believe the ignorant persons that have no base of truth.

So, no they do not have to inform you.  If they really did, do you not think that undercover would be done with in the 80's.  Every dealer would know the first question, "are you a cop," and then the guy would say yes, and he would send him out of the office.  Come on man!

  11. They will be happy to let you know they are cops, once they have enough to arrest you.  Enjoy jail, don't drop the soap!

  12. Of course not.  They can also lie and say they are not.

  13. Nope, and inspecting their wallet won't help either.  I wonder how these rumors get around?

  14. If you're not a criminal you have no reason to care.

  15. To the point that the officers are engaging in the undercover activity, they are not required to inform you of who they are (would be a big downer to walk into gang territory and have to tell everyone 'yeah, I'm an undercover cop here to hopefully bust you all. Can I still join?')

Only when they are about to engage in the legal/directed aspects of law enforcement (make an arrest) do the police have to identify themselves, so that the 'suspect' is not able to argue in court that they did not know who they were defending themselves from (even criminals have a legal right of self-protection.) Someone pulls a gun without identification, even a police officer, its technical grounds for self-defense, since the person has a reasonable expectation of being able to defend themselves.
