Do we get to keep our stimulous check?

We just got a letter saying we are getting a stimulous check from the IRS at the end of the week. Problem is that my idiot husband didn't file taxes for like 4 years and owes about $20,000 to the IRS. He has been paying it off for a year now. They took our $4000 tax return to pay it. We just got married in Nov. so none of the debt is mine. Are they going to keep the check? We haven't gotten a letter saying they are yet.

  2. You need to file an injured spouse claim using Form 8379 which you can get from the IRS web site. You will be entitled to 1/2 of the stimulus payment for sure. You may be eligible for some of the $4000, depending on what state you live in and/or how much tax you paid in yourself. Processing time is 8-11 weeks.

  3. Sorry, but yes they'll keep it and apply it to the back taxes.  You'll be getting a letter saying so.

  4. The IRS will apply the Stimulus amount to any unpaid taxes.  You file an Injured Spouse Claim with the IRS and if approved you might get some of the Stimulus amount and maybe part of you refund back.  Check with your tax professional.
