Do we have to right to "Discovery" in Southern California?

I want a copy of the officer's notes on my case so i can prepare myself for the case. Is there and way i can see his notes on my ticket?

  1. You do have a right to discovery but that doesn't necessarily mean that you can get the notes.   In most cases, with most prosecutors, no motion is necessary.  A simple phone call will get you what you want.  Otherwise, you are entitiled to see any evidence that the prosecutor intends to introduce at trial, and any "exculpatory" evidence.  Once at trial, you can ask the cop if he reviewed his notes in anticipation of testifying.  If he says yes, then you would also be entitled to see those notes at that time.
