Do we really get Free Speech?

I struggle with this one. I see that a man was awarded $11 million from a church that is anti-homosexual because the leadership demonstrated at his son's funeral. While I do not agree with the vitriolic speech the pastor and his daughters used, what about the free speech implications? Haven't the KKK and other hate groups been protected under similar circumstances, based on first amendment rights? I don't know all the details about this case, but it disturbs me that they are bankrupting a church like this. It seems like the heavy hand of government and lawyers stripping away basic civil rights to speak and protest.

If this funeral was not on private property (I really don't know whether it was) it seems clearly the government (as represented by the courts) has overstepped it's boundaries here.

  1. I would guess the funeral was on private property, but more importantly, this Lunatic Fringe Church was attacking private individuals in a hostile public format.

    The KKK, NAACP and other intolerant racist bigoted groups do have protection.  BUT... the right to swing your fist ends at your neighbors chin.

    Second, if it is that idiot who protests at the funerals of American soldiers because the military allows g**s to serve then his "church" deserves to be bankrupted.

Although in the constitution it is stated that we are allowed the freedom of speech; come on; when have qwe gotten it when it comes to speaking our minds to authority without any consequences. Whether it be in fornt of a judge we are held in contempt or in front of our employer we are terminated.

    The answer is simple there is no freedom of speech.

    Freedom of opinion, but no someone was high when they placed freedom of speech, expression, or anything in the constitutions.

  8. If it was truly free then we could say anything about any one true or false . What people don't want see and say is this  ."we have the right to speak right and truth but not the right to speak false hood, or hate  ".So it has been twisted so that any one can say almost anything they want as long as they don't get caught .

  9. a funeral, whether at a home or a cemetary IS private property. And no one has the right to disturb a private function such as this. and i'm glad they got awarded this money. Because dude, unless you are a part of a minorty group that has been treated like this church treated someone, a HUMAN BEING, then you have no right to say anything about anything.
