Do you believe that women get laid off alot especially in court or jail sentences?

Im talking about America only, no other country. Im really strict on jail time. I dont care what gender you are, your going to jail for the crime. I believe that If you kill a person regardless of age, you should get death penalty period, no trial, no jury, no nothing. For example: If a men kills a 15yr old boy with a gun he gets death sentence or jail time for life. If a woman does the same it should be the same sentence, not freaking letting her go by a few years. I dont give a rats if your pretty, hardworking, and respectful, your going to jail. People dont bring up children into this topic, because I'm speaking of Single Women and Men only, without children. If you dont answer the question or insult me, I'll report you in a heartbeat.

  2. Gender is not a basis for sentencing.  The reason why women are usually not on Death Row is because women statistically commit fewer crimes than men and most of the crimes that women commit are property crimes, not violent crimes like murder.  

    However, the death penalty is different than other sentences as first, there has to be a conviction, then the jury has to weigh aggravating and mitigating factors.  There is essentially two trials one to find the guy guilty and the second to find whether or not he should be put to death.  The jury would then recommend to the judge the death penalty and the judge is free to follow the jury's recommendation or do his own thing.

    After the defendant is sentenced to death, the case is automatically appealed to the State Supreme Court.  About 70% of all death penalty cases are overturned on appeal.

    I AM NOT SAYING THAT THE DEFENDANT IS FOUND INNOCENT, but for some reason the State Supreme Court decides that the death penalty was not warranted in the case and the person is then usually sentenced to life in prison.

    Well, then let's see.  If 1000 men commit a murder and 100 of them are sentenced to death ... if 70% of their death sentences are commuted to life, that would leave just 30 of the 100 murderers on death row.

    However, since women commit fewer murders, and when they do they are almost always their boyfriends or husbands.  So now, you have just 100 women that commit murder and 10 are sentenced to death, and 70% are overturned on appeal you now have just 3 on death row.  

    If you were to look at death row and see 30 men and just 3 women you might conclude that "gee, women are treated differently."  But that just isn't what is going on there.

  3. You are right, unfairness is inherent in the current system. The jury gets to choose between life and the death penalty, or the judge gets to choose. Maybe you don't care about statistics, but black murderers are much, much more likely to be sent to death row than white murderers. And perhaps women are also more likely to get life. It's a biased system. That so many people on death row have been exonerated by DNA tests shows that it is a faulty system too.

    When you say no trial, do you mean no trial to determine the sentence, or no trial at all? Our justice system is based on trial by jury, and it's reprehensible to execute people for murder without even putting them to trial.

    You really should look at statistics before you start making arguments that women are getting treated better than men. I would guess that most women sentenced to 25 to life do not get early parole, just like the men.
