Do you consider this PARKING?

Yesterday when I dropped my friends off in front of their house with the engine still RUNNING and still when still stepping on the brake petal--a cop pulled me over for parking in front of the "yellow fire" thingy and arrested my friend for having drugs in this possession. Do you consider this parking when my engine IS not even off and I'm not even stopping to drop my friends off in the driveway?

  1. No.  Stationary vehicle with the driver inside and the engine running is "STANDING", not parking.

  3. If this fire ..um... thingy... is in front of his house, then it's possible that many people (his family, guests, etc) have stopped in front of it.

    You might call the police department and ask if an allowance can be made for whoever pulls in front of his house, as this will probably be an on-going occurrence.

    Let me ask you this: The area where your car was sitting; was it marked off with lines, or with a sign? If so, then the cop might have a legitimate gripe.

    I don't know. Try calling and talking to them. They might listen to good reason, if you present it respectfully.

    In most states, stopping in a no parking zone is illegal, regardless of how long you are there.

  8. if your vehicle was not moving you are stopped it dose not matter if your engine is still running.  so yes the officer was correct.  it is like when you get drunk and decide not to drive but sleep it off in you car, you are considered in control of the vehicle and will still get in trouble for it.  why did the officer talk to your friend? did your friend give consent to the officer to frisk him?
