You can if you are lucky, but normally you get one that broke and Microsoft has fixed that isn't yours.

Not usually.  There used to be problems with a compound that they used on the graphics processor that cracked; that required a replacement.  Anything else is usually fixable.

Most of the time they'll give you your refurbished one. A way you can check whether it's a new one or a refurb is to take the faceplate off the front of the 360. Check near the ring of light, if there's a silver sticker that just says Microsoft on it, then congrats, you have a brand new Xbox 360. But if there's a greenish sticker on it then you have a refurb. :(
