Do you have any legal actions you have to take when you create a rental lease agreement?

We are going to rent our home on our own and need to know if after the lease has been signed do you need to get it notarized or have if filled with a certain agency? Or do you just do the paper work and your done?

  1. Notarization of a document doesn't make it legal.  All the notary signature and stamp means is that they witnessed the signature of "Jane Doe on July 1, 2008".  

    Notaries are not legal experts nor lawyers, that is why it doesn't make the document legal, b/c they cannot legally speak to the document or whether it's valid or not.

    I would encourage you to go through a real estate attorney for the lease so they can also educate you on how to evict, the proper way to collect a deposit, records you need to keep, etc.


  2. no offical stuff needed. Just make sure that the tenant understands all their obligations, give them a copy and make sure you keep a copy.
