Do you have any recourse if a realtor misrepresented something before the sale and now says they did inform u?

My son put a bid in on a house and the septic system failed. He almost backed out of the contract because it did not want a sand mound. The realtor assured us that this would be an "at grade" system and it would be flat. The new system is now in and it is anything but flat, not even close. Does he have any legal recourse in this matter or is he just stuck?

  1. Agents have to answer to a higher power.  Look up the real estate board in your area and file a complaint.   I would go as far as contacting the office and finding out who is in charge and give them an ear full as well.

    the more you complain to people the more this person is going to hear it...

    make their life a living h**l...   its called KARMA...


  2. He is stuck.  You now have a 'he said-he said' situation, with nothing in writing. How will your son prove that he was misrepresented, and not just complaining 'after the fact' ?  If that issue was so very important to your son, the conditions of the septic replacement should have been handled in writing.  THEN you would have a leg upon which to stand.

  3. He will win in court.  But the judge would look at your son's personality.  If he is a strong personality, the judge will be wondering why he was such a timid person about the septic.  But if he is a trusting soul, he will win some money. /
