can anyone hand out punishment without going to captains mast?

  1. Captain's Mast is Nonjudicial punishment.

    The Captain decides if you're guilty or not.  But usually, before it gets to him, the XO and all the others in your chain think there has been an issue.

    I.e., if you are going to Captain's Mast, you are guilty.  Only the punishment remains to be decided.

If charges are brought against you, you will go to Captains Mast.  But first you will see the CMC at DRB =Disciplinary Review Board.  If they think there is a valid case against you they will send you up to XOI with the Executive Officer.  XOI stands for Executive Officer Inquiry.  If they too believe there is a valid case against you then you will be sent to Captains Mast with the Commanding Officer.  With the Navy most of what goes on day to day with people getting in trouble is caused by hard evidence with lots of proof or the perception of wrong doing that still has valid proof or witnesses.  In any case if you are being accused of something and you became a valid blip on the  radar looks like you will be very closely examined through the whole legal process I just explained to you.  Stay out of trouble, don't hang out with stupid people and use the common sense most people ignore and you can go your entire Navy career without ever going through this process.  Your other choice is to waive Captains Mast and go straight to being on restriction for 45/45 if you already know you are guilty.  Saves time and getting screwed at for a few weeks.  I recommend you go through the process though, you should learn a lot and maybe grow up a lot in the time being.

  4. You are already close to be guilty if the person feel that he is innocent then go for the next step request a general court martial and prove your case. Its a higher risk but you made it this far if you were innocent it would never pass DRB unless you are really guilty of something. You can always challenge the ruling against you within 5 working days of your verdict or request court martial while at mast and make them prove their case. I wont recommend having court martial unless if they got no evidence against you.  If they offer restriction time to you it sucks but you can always rebound from that in time. Pick your choices wisely spend couple weeks of doing EMI and restriction or risking going to Brig and get discharge.

  5. Captain's mass will most often be used for offenses such as DUI, larceny, etc... rarely will the captain find someone innocent, mast's are almost entirely used as punishment hearings.
