Yes you do, if the car gets stopped by the police and you are not wearing your belt, the driver of the car will get a fine.

All rear passengers that are under the age of 16 should have a seat belt on. This is in New York State, and by the way New York was the first state to start this law and it went into affect in 1985.

So if you want to be legal, the answer depends on where you live.  

Of course, we also have free-will; technically, we don't "have to" do anything, if we are willing at accept the consequences, which include increased chance of injury and an increased chance of dying.

It depends where you live.  In most places, there has to be a seat belt for every person in the car, and they have to be used.  In most places, the driver gets a ticket if a juvenile isn't belted in, but the passenger gets the ticket if he/she is an adult.

If you want to be thrown out the window if any accidents occur, then by all means don't wear one =) BUT if you want to be safe, and not get thrown out the window and want to follow the rules, then DEFINITELY you should wear a seat belt no matter the age.
