Do you have to pay an employer back for overpayment when you left a job?

I just got a letter in the mail from my previous employer saying they over paid me on my last check (I used vacation time that wasn't accrued). This was in sept 2007. My question is do I really have to pay. If I don't pay this $859.00 can it go on my credit report. Again this was from Sept 2007.Please if anyone knows anything about this stuff I need your help. Thank you

  1. Yes, you do have to pay it back.   Your former employer could sue you for the money.

    If they turn the debt over to a collection agency, it would be reported to the credit bureau.  

    You should check with your local dept of labor and see what kind of rules there are concerning payback periods.


  2. If I were I will contect them and start paying what you could every month.You it's not your money.you know they made mistake.So why not pay it back? If you don't pay they will turn you over to collection.

  4. Yes, you have to pay it back if you weren't entitled to it.  They might let you make payments rather than pay it all at once.

    If you don't pay, they can take you to court - and you'll lose.
