  1. All countries have caught on to the mark-it-as-a-gift scam to get out of paying import taxes.  Often the cutoff is $20 beforre they start charging.


  2. If you are receiving a gift from some one outside the US you have no tax issue unless you sell it.  Your state's sales tax would not apply and there would be no taxable income.  Now if you really ordered the item and they are marking it as a gift to beat the import tax you are out of luck, pay the tax.
