I had a insurance policy at work and was paid 60 per cent of my paycheck. Then i son SSD and I had to pay them back all the money I got. I did this. However now a check arrive in my Sons Name who is no 19 under my family social sercuity benefits in hus name. Now Aetna life Insurance wants the money and tht is OK, They are rusing to put the overpayment in my sons bname who has the check and SSD satates he will be taxed on it. So at the end he pay them 6,000 and he pays the taxes because they will not syate he ispaying the money that I am. And then I will be cheating on income tax because I did not get this money. Aetna does not care to help SSD states it is his and he does not have to gice it to them but we do I signed paper that I will pay back what I receive from SSD if I win. If I do not pay soon they will cut the portions they gice me each month th make up for the money from SSD because I young and did not pay in enough to get a lot so they pay the rest to equal 6- per cent

  1. What is your actual question?

  2. As I understand it correctly, you became disabled and started receiving benefits through Aetna from a policy you had work. You applied for Social Security Disability benefits and were approved. Since they pay back benefits, you repaid Aetna the portion that was due from SSDI during the time you received them. Then your son received a check based on your benefits which Aetna apparently wants as well.

Does the benefit you receive from Aetna include a portion for your son? In other words, would the benefit be lower if you didn't have a child? If so, then I think Aetna probably does have a claim on part of that SSDI payment. If not, I don't see how they can take it.

As far as taxability goes, your son would have to have at least $25,000 in other income for it to be taxable, so it's probably not a big deal. The payment for your son wouldn't affect your tax liability since it's recorded under his Socla Security number.

  3. You ramble so much that I can't figure out what the problem is.
