Do you notice that our judges always give jail-term discounts to the rapists?

According to the penal code 376, a convicted rapist will have maximum jail term of 20 years and 12 strokes. However I have never seen the maximum penalty imposed to the convicted rapist,since I learn to read news articles 10 years ago.

Do you feel the current law is heavy enough for punishing the rapist and give some kind of compensation to the victim?

I am very angry with the judge who always give jail-term discount to the rapist, while I have never been given discount of punishment for ponteng sekolah.

    jail term discounts should come with a price la..

    example : multiple slices on rapist's genital..

    then if jail term discount is 10 years, then he has to wear an unremovable (got such word or not?) genital clip that doesnt allow him to have an erection for 10 years...

    ok ok..im twisted i know..

    but imagine the physical & emotional pain + scar the victim has to live with forever..

    (thinking of joseph fritzl case)

    if im the victim, i'll probably kill the rapist myself after making myself satisfied..by disintergrating his private parts & squeezing lime on his wound..


  2. It said Maximum to 20 yrs. This guy only 26, if give him 20 yrs in jail. When he came out then he is 46 already. I don't know how does the judge did his job. May be he let him get some discount. Last time I found a news said a father was sentenced for 10 yrs of jail after rape his own daughter. The judgment  is base on the evident show to the judge also. If the police came came up with others evident then the sentenced will be shorter then 20 yrs. May be the police didn't give the judge a full perspective. All of the system is link together.

  3. Very very frustrating,,most of the punishment for criminal cases are meant to teach criminals lesson but rape case,, i would say is different, because womens lives are ruined,

    imagine if it happens to one of our family member,, especially teenage or even kids nowadays,, how'd we feel?

    at least a tiny group of ppl who murder, rob a bank might have reason (perhaps they were protecting themselves or others,, or they robbed because of poverty or injustice that is happening to them)anyway, im not supporting them,, just trying to tell how serious is a rape case.

    But what is the explanation for rape cases???

    Injustice for not getting s*x? Argh!!!

    I think better for the judge to sentence them for life,, or else i'll kill them if i see them on the street.

  4. you reminded me of an awful event that happened to me few years ago.

    A pervert broke into my house, attempted to rape me,

    but Thank God, nothing happen to me.

    It was a traumatic experience, but the interrogation

    with the police got me left with nasty scar that I will never forget till I die.

    While I was crying and sobbing because I was scared to death, two policewomen mocked and laughed at me

    and said that probably I was just making up stories.

    To h**l with police!

    Only when they see a bloodbath, then they will parade to the media they are going to find the culprit and doing the best job they can.

  5. Sometimes the Judges " MODE "  make difference , sometimes because of the Judges don't like that " case ". or even because of some " reason ", egg, Anwar case ,sometimes ago !

  6. This is not as what we perceive as "discount". Rarely a judge will sentence to the maximum in any offence, being serious criminal or even minor traffic offences. A judge has ample discretion to use when it comes to sentencing, and will give consideration to various factors. Of course, it also depends on how much sweet talk quality his lawyer has.

    I know that a particular indian female judge in Melaka never hesitate to give harsh sentence when it comes to rape, especially father-daughter, or uncle-niece situations.

  8. All too often this is true.  Its sad, but people believe that there is 'help' for those people.  

    I dont believe that anyone can be 'cured' from those feelings and should be punished to the fullest extent of the laws.  Maximum sentencing for ruining or scarring someone elses life is not too much to ask.

  10. Yes, probably. I only noticed a case which was given a quite high penalty in 2004 where the rapist was imposed with 19 years’ imprisonment and 12 strokes of whipping for raping his 15-year-old daughter in 2001.

    The judges may have made those decisions out of sympathy for the wives and children of the offenders. The economic status as well as the age of the rapists, his plea of guilty and the duration of time that criminal had been in remand and for other reasons as a particular judge thinks fit based on the facts of the case; so on and so forth.

    Some people may think that the law right now is sufficient. Frankly, for the longest time, I do feel that the current punishment is far from adequate. For me, public canning might be a good idea (Should be done in proper way. Public interest also has to be taken into account) .

    Your idea is a brilliant idea. I’m with you. The victim should be relevantly compensated.

You need to broaden or widen the scope of fair and justice ... justice is not for the victim per se ... justice is for all ... fairness includes both victim and the accused ... yes it's true the statute provides a maximum 20 years and strokes ... however you need to consider the mitigating factors during the trial otherwise it's not fair for the accused ... in criminal litigation the lawyer will submit to court [inform not putar belit] the current and previous condition of the convict ... and the judge will consider it and compare it with the offence before he/she come out with a decision.

    Example of mitigating factors:-

    1. Plead Guilty

    2. Age

    3. Education

    4. Health (include mental) condition

    5. Income

    6. Influence

    7. Family (mom, dad, spouse, children etc)

    8. Cases (Judicial Precedents)

    9. Situation at the moment

    10 ... woi so many lah u check in  criminal law textbooks lah

    *yet ... as a human being we will never get an absolute justice... until the "final judgment day"
