Do you own the area under or above your property?

Do you own your land as far as it goes underground or is there a point in which you dont own the land anymore and the same for above how many feet do you own above your house or land since airplanes and other flight vechiles fly over peoples land all the time.

If a state wants to be a subway tunnel 300 or 400 feet under your house what can you do.

    Mineral rights (under ground) can be owned by someone else.

    Above is usually considered public.

Airplanes and stuff flying over your house don't count, but you DO have the exclusive right over CONSTRUCTIONS on your "air space" and below the ground.  Your neighbour cannot build an extra room just over the wall, sustained by a crane, just as he or she cannot build a basement that crosses the line of your property.  Any such constructions would need your special permit, they would require negotiations, unless other use of your property is declared, by a Court of Law, to be "of public interest": but that is an exceptional case.  

    In many countries you don't own mineral resources found under your property.  But in the US it's not like that: it's the finder's keepers rule.  

    If someone wants to build a subway tunnel 300 or 400 feet under your house they would have to get your consent as a stakeholder, and negotiate the price with you, or else they'd have to get a Court order under the argument that a subway line is of public interest and therefore the will of the "people" should surpass your right to your property...
