  1. Homeowners associations are totally voluntary organizations.

    When someone buys a home, they have a total right to choose to buy one that is in an HA, or not, whichever they prefer.

    There is no legal basis for anyone to say that a group of homeowners may not choose to form an association, and agree to be bound by its rules. No-one can be 'co-opted' into an HA against their will, so HA's are free to regulate themselves however they choose.
