Do you think I met the residency requirement to become a citizen in the U.S.?

I came to the U.S. on July 23, 2003.

Today is Aug 10, 2008.

During these years, I was out of country 281 days (accumulatively).

I did NOT stay out of this country for more than 6 months each trip.

I went to apply for naturalization on April 2, 2007 but they said I haven't met the residency requirement at that time....

I'm wondering if I can try it again now...

  1. What's the date on your Green Card?  90 days before the 5th anniversary of that date you can file the N-400.

    **************Please tell me you had a reentry permit when you left the USA for 2 years (I-131).  If not, you're incredibly lucky to have been let back into the country.

    Take the date you came back, after the 2 year absence, add 5 years.  You can file 90 days early.


  2. As long as none of the absences are more than 45 days consecutively you residency is continuous and you have achieved your five years. Yak rider is very good on this stuff so if he says one thing and I say another figure my information is out of date and his is probably current.

  3. The first day you are eligible to apply citizenship is 90 days before your 5 year anniversary of green card approval date. So check your green card for the approval date and calculate the days.
