Do you think I met the residency requirement to become a citizen in the United States?

I came to the U.S. on July 23, 2003.

Today is Aug 10, 2008.

During these years, I was out of country 281 days (cumulatively).

I did NOT stay out of this country for more than 6 months each trip.

I went to apply for naturalization on April 2, 2007 but they said I haven't met the residency requirement at that time....

I'm wondering if I can try it again now...

  1. You have to know if this is a time when America is excepting new applicants.Normally its all over the news and its a big deal.Other than that watch for La emigre.


  2. What date was your green card approved?  That's the date that matters, not the date you arrived.  If you look at the green card there's going to be a date on it.  Add 5 years to that date.  You can file 90 days early.

    Your absence from the USA is no problem.

    ***********Please tell me you had a reentry permit when you left the USA for 2 years (I-131).  If not, you're incredibly lucky to have been let back into the country.

    Take the date you came back, after the 2 year absence, add 5 years.  You can file 90 days early.

    So, YES, it looks like you are good to go if you came back July 23, 2003.

    Since you became a US Resident in 2001, subtrack the days that you spent outside the US. It still leaves you with 6 years and 84 days (tomorrow). In 2007 you were only a few days short.

    You should be able to apply now...

  4. you might have. just try it but be careful because la migra has been tryin to find any excuse to deport but anyways i think you have because you have to be here for atleast 5 or 6 years
