I was in the States with a Tourist Visa, valid till 2016, 6 months every entry to the States. I came here cuz of my bf,a soldier that I met in Italy, my country, dating for 3 years I decided to follow him to the States, made a tourist visa because, before getting married, we wanted to see how things were working out here. I always, respected my Visa limit. I've never stayed in the Stated more than 6 month at the time, honestly I've always went back and for in Italy evry 4 months, to see my family. Last time I got to the States it was supposed to be the last one because we finally decide to get marry. Well, they denied my entry cuz they say I lived in the States 8 month out of 12 and I wasn't a tourist nomore but I was living there. They told me that I will be able to entry just if I obten a Fiancee Visa, which my Bf is going to apply for. They assure me that once I get that Visa I want have problem to entry...What is your opinion about? Will I be able to marry the man I'm in love with?

  1. From reading your posts what you should do is to get in touch with a very good immigration attorney and they will help you go through the whole legal process in obtaining the k-1 visa. The thing about it is that the USCIS has recently raised fees for all applications. The best immigration attorney who can help you through this process is a law firm located in La Jolla California by the name of Holmes and Lolly. Go to their website at www.holmesandlolly.com. They even have a toll free number you can call and they will even give you free advice. Just remember this is not a cheap process you are going to go through, probably with attorney fees and application fees you are looking at $3000 to be conservative.

  2. tell your fiance to get a visa for you at the USCIS

    Petition for Alien Fiance(e)

    Purpose of Form :

To petition to bring your fiancé(e) and that person's children to the United States for marriage to you or to bring your spouse and that person's children (K-3 and K-4 visas, respectively) to the United States to complete processing for permanent resident status (under the LIFE Act and Amendments of 2000); please see section 12 of the instructions to the form.

  3. Yes, but you'll both have to be very patient.  I've just obtained the sam category visa to the UK.  Im American.  There is ALOT of paperwork.  Lots of things to be proven.  My advice to you both is to get an advisor, in Italy or America.  This person will help you put things in order.  We were able to get one for free here in the UK because of income.  Also if there is an option apply online (make sure your paperwork which you send in is perfect).  Online is much much faster.

  4. Unless you have an ineligibility that you haven't mentioned, you should have no problem getting the fiancee visa:  to go to the US, marry and live with your boyfriend is exactly what this visa is designed for.

Now, light a fire under that boy and make him file the I-129F as quickly as possible.  Good luck!

  5. Yes. you should have little problem with that as my friend just did the same thing with his now wife from the phillippines.

Good luck on your impending marriage.
