  1. Yes, because of the US Constitution.


  2. Yes because then the people in each state could truly decide what they wanted, and per intentions of our founding Fathers, the states were supposed to have more power and the federal government was supposed to be as small as possible.

  3. They should defer to states rights in ALL ISSUES not explicitly outlined in the Constitution.

  4. Most would say that the issue you mentioned should be state issues.  But with the Gonzales v. Raich supreme court desiction the court has said that at least one of the issues is in federal hands.  This ruling could be late applied to all subjects that the state was to hand but the fed want to over rule.
