I work for the state of California, where the employees and patients have been banned from smoking anywhere on state grounds. This includes outdoors. Are there any laws requiring employers to designate smoking areas outdoors for employees ?

  1. Nope!  You stink pots are on your own.  It is the same reason an employer is not required to provide a place to drink alcohol.  Go home if you must stink up the place, even the outdoors.

  2. No, they are not required to provide smoking areas. Sorry, but you do live in California. You could always move down here to LA where we don't mind.

  3. Unfortunately not. But you could always go to the sidewalk. Its off the premises.
