  1. Unlike speeding, where the amount of speed you go above the posted maximum speed limit will determine fine amounts;  BAC is a true or false reading.  Either you are above the state's allowable limit or you're not.  If you are, it's a DUI - there are no levels of punishments and sanctions based on the amount of alcohol found in your blood.


  2. Here in Arizona, yes, it does make a difference.

  3. It depends on the state. Some states are black and white(.08 and .30 are a simple  DUI case.) Other states enhance the penalties for higher bac's. One  thing better about a .09 is you may be able to get it reduced or possibly thrown out. This is so close to the legal limit that an attorney could argue you may have been below .08 at the time of operation.

  4. Yes, it would be considered aggravation.  The higher the limit, the more dangerous the driver could be.

  5. I don't know what these people above me are talking about but yes it does matter. I know from personal experience let me tell ya. There are three levels with different sets of punishment. All states are a lil different.

    -General Impairment penalties (Undetermined BAC, .08 to .099% BAC)

    -High BAC penalties (.10 to .159% BAC)

    -Highest BAC penalties (.16% and higher) or Controlled Substance

  6. It depends what state your from. If your from PA it does matter. The higher the BAC the greater the penalties are.
