Does a U.S citizen have to be LIVING in the U.S to be your sponsor?

Ok, here's the deal... I am from Canada and want to be able to work in the U.S.

Now, my aunt has dual citizenship, but she is currently living in Canada. Can she still sponsor me?

What's the best way to go about this?

  1. Your aunt can't sponsor you anyways, not a close enough relative.. For family based immigration, the I-130 is filed.. Here's the I-130

    Right from the instructions-

    "If you are a U.S.citizen you must file a separate Form I-130 for each eligible relative. You may file a Form I-130 for:

    A. Your husband or wife;

    B. Your unmarried child under age 21;

    C. Your unmarried son or daughter age 21 or older;

    D. Your married son or daughter of any age;

    E. Your brother(s) or sister(s) (you must be age 21 or older);

    F. Your mother or father (you must be age 21 or older)."

    If you were an eligible relative, then she would still have to be living in the US or have proof that she still had a residence there to be a sponsor..

  4. Well, for starters, aunts and uncles can't file immigration papers directly for their nieces and nephews. They could file for your parents, but that would take so long, it wouldn't do you any good even if your parents wanted to be sponsored. However, in addition, any relative who could sponsor you who didn't live in the US would have to establish residency in the US before or simultaneously with you. Immigrant visas are for family reunification. That doesn't apply if your relative doesn't actually live in the US and has no intention to live there.
