Does a cop have a right to search through your friends car for finding a air soft gun in the front seat?

Okay i was sitting in my friends car with two other kids. and cops rolled up and saw a air soft gun in the front.

So they put us in gun point. Then got out of the car. and they searched it and found some ****. I just need some help to fight against this cause i am getting charged for it and it wasn't even mine.

  1. In some states,such as Texas if you get pulled over for a traffic violation the cop has the right to search your car.


  2. If the Police, having found the gun, had not searched your car, I would have expected them to have been thrown out of the force.

    The discovery of any weaponry should, in these days of terrorism, initiate further investigation. If it turns up any form of wrong doing, then so be it; one less criminal on the streets!

  3. yes they can  search as they had resonable cause. but as far as I guess your talking about drugs was found in the car. so   they would have to prove that it was yours. was it found on your perosn  or loose in the car. if it was loose in the car then  they cant prove whose it is and would have to charge all people in the car. or throw it out. next time dont get in to that situation and not have a airsoft gun in a car or have drugs in the car.

  4. The air gun was probably interpreted as probable cause.   All of you could and should be charged for the drugs,   if your friends aren't it probably means they rolled over and fingered you.   Will they testify?    Who knows,   but that is your lawyers problem.

  5. To stop you a police officer must have a specific reason to suspect your involvement in a specific crime and should be able to tell you the reason.

    This is known as reasonable suspicion.

    Most times you are probably getting pulled over for a traffic violation such as speeding or maybe a tail light is out.

    Although the stop may seem wrong or unfair, the police believe they have a reason to stop you and the gun was a big reason.

  6. The search was legal. And you're screwed. If no one in that car confesses to being the owner of the so-called "****" then, by law it is possessed by everyone in the car.

    Instead of fighting against something that is supported by the rest of us law-abiding, respectable people maybe you should confront the friend who owns the "*****" and make sure the b******e doesn't get you in trouble.

  9. yes the cop has every right to search your car for any suspicious act and if he find anything suspicious thing... well if he seen it then yup he has every right to search and they also found some **** oh you are in trouble the point is that you were in the car sitting there when you go to court just say it isn't yours and you don't know who it is and you were just sitting in the car minding your own and being inside taking charge with the kids inside you don't have anything to do with the charges that they charge you with and that you don't know who's stuff it belongs to cause your in your friends car it happens... so just tell you lawyer that it isn't yours and besides you were sitting in your friend car so you don't have anything to do with it that is all you have to do and say no more and keep saying you don't know cause  you were just sitting in your friends car that is all no more and keep saying that and that is it plain and simple
