I have custody of my 8 yr old grandson two years. The absent father is a MA. resident and wants custody. We tried summer visitation but it did not go well, the father is now filing for custody. We are TN residents but because of my husbands job will be staying in Michigan. How does that affect the order?

  1. Yes

  2. Depending on Daddy's proven character he has a better position as a parent of winning custody. Consult an Attorney in Michigan. He'll probably have to do some research about TN and MA law but the case may end up in MA court. You may have to defend your custody in a Massachusetts court. You've left the protection of the TN jurisdiction where custody was established but if you can still claim residency, that may help. Regardless, the custody can always be challenged and he certainly has an advantage. Even with some minor character problems he has a good chance of winning his case if he can prove that he has the means to properly care and provide for his child.
