Does a judge usuallly decide what a social worker reccomends?

I am inviolved in a cps case. The social worker is reccomending tha my children stay in custody for the next six months.

  1. NO the Social worker makes the recommendation to the Judge and the Judge approves it or not!  Get your act together and get your kids back for God's sakes!  Either that or give them up so they can go to someone who WILL take good care of them so they don't have to stay in foster homes and get moved from one place to another.  Anything else is just selfishness on YOUR part!


  2. The ultimate decision is made by the judge. It is the CPS workers job to do the investigation and make a recommendation but the judge does not have to go with that if they think it is not in the best interest of the child. The GAL will also make a recommendation. The last thing CPS workers do is remove from the home and reunification is always a goal that they help you work towards. Follow all recommendations and I am sure you will get your children back soon.

  3. No if it comes from a judge then normally it's a court order or a judgment that the court issued.

    If it's a recommendation, then it's the social workers recommendation based off her experience with your case and others.

  4. Usually unless you have a nut job judge like I did. Best of luck to you and the kids!
