My landlord is selling the building and left a note under my door this evening that there will be a showing at 11am tomorrow. I have a dog that is not friendly with strangers and I need to make other arrangements when there is people coming to view my apartment without me here. I have to work tomorrow morning and won't be home until the evening and I have not been able to get a hold of my friend who usually dog sits for him in these situations. Do I tell my landlord he can't show my place? WTD?

  1.    Restrict the dog to a back room.  Put a note on your door telling your landlord you attempted to contact him but were unsuccessful.  Explain that the dog is not friendly when you are not there, but as you had to work, he is restricted to the back room and you would advise him not to open that door.  Tell him that in the future, if you were given more notice, you could arrange for the dog to be elsewhere when he comes over.

  2. By right you can deny him access without 24 hours notice, but you aren't going to be there so I would lock the dog in one room and put a note on that door explaining about the dogs temperament. Even though the landlord is wrong, it is best that you allow him in, but tell him in the future you need 24 hours notice. The answer to him having to give you 48 hours notice is..no. It's 24.

  3. He has to give you 24 hours notice and you can not deny entry.

Take the dog to a kennel for the day if you have to.

If you must leave the dog confine him to a small area and leave a note on the door.   Since he is selling the entire building he may not even have to show your unit.

  4. In USA a landlord must have tenant's permission to enter the rental unit. In your case, a landlord's note under the door does NOT give him the right to enter your apartment. There is no specific time requirement, but the two of you must have a verbal or written agreement to show the apartment.

Your responsibility as a renter is to be sufficiently accomodating in granting access to the apartment. So just call your landlord and tell him what's convenient for you. In extreme cases when a tenant refuses any reasonable access to the apartment and it costs the landlord potential future renters, he can charge the previous tenant an extra month of rent.

  5. The notice requirement for the landlord to enter to show the property varies by state.

Most states require only 24 hours notice.

Also, if the landlord posts the notice or slips it under your door at 9am, the clock starts ticking from the time the notice was posted or "delivered" - not when you receive it - so the landlord can legally enter at 9am the next day.

In many states a tenant's permission is not required and a tenant cannot unreasonably refuse the landlord entry.

You should do as suggested and put the dog in a closed off room for the day and leave a note for the landlord.
